Public Hearing - Zoning Amendments for Bylaw Dispute Adjudication System

Pursuant to Sections 464, 465 and 466 of the Local Government Act the Regional District of Nanaimo (RDN) advises of a public hearing regarding a zoning amendment for “Regional District of Nanaimo Land Use and Subdivision Amendment Bylaw No. 500.426, 2019”

The RDN recently established a Bylaw Dispute Adjudication System for the ticketing of bylaw contraventions. To enable the Bylaw Dispute Adjudication System to be applicable to contraventions of development permit areas, amendments to zoning Bylaw 500 are required. The purpose of the bylaw is to add an enforcement clause and maximum fine to the Part 5 Development Permit Areas, and amend the wording of Section 3.2 General Operative Clauses for improved clarity. If adopted, this Amendment Bylaw will allow for contravention of a development permit area, to result in a fine and be adjudicated through a Bylaw Dispute Adjudication System. These bylaw amendments apply to the following Electoral Areas:

  • Area A: Cedar, South Wellington, Yellow Point, Cassidy
  • Area C: Extension, Nanaimo Lakes, East Wellington, Pleasant Valley
  • Area E: Nanoose Bay
  • Area G: French Creek, San Pareil, Little Qualicum
  • Area H: Bowser, Qualicum Bay, Deep Bay

All persons who consider their interest in their property to be affected by the proposed bylaw shall be afforded an opportunity to be heard in person or by written submission at the public hearing. Written submissions can also be provided in advance of the public hearing and must be received at the RDN office by 4:30 pm Monday, June 17th to ensure their inclusion in the public record.

Where can I inspect the Bylaw?

A copy of the proposed bylaw and relevant documents may be inspected at the hearing or until Tuesday, June 18th at the RDN Administration office located at 6300 Hammond Bay Road, Nanaimo, BC, Monday to Friday (excluding public holidays) 8:30 am to 4:30 pm, with extended business hours until 5:30 pm on Wednesdays. The public hearing for this bylaw will be chaired by Director Rogers or their alternate as a delegate of the Board.
