Wheel Loader (Quick Attach)

The Regional District of Nanaimo (RDN) is seeking responses to the following tender:

This tender is for the supply of one (1) Wheel Loader (Quick Attach) for use at the Regional Landfill, Nanaimo. Copies of the tender may be obtained on or after July 24, 2017 at the Regional Landfill or can be downloaded below. Copies will be mailed upon request.

Sealed tenders clearly marked "Wheel Loader" require delivery by hand or courier only at:

Up until 2:00 pm on August 16, 2017. Faxed copies will not be accepted.

Responders are required to respond to all specifications for new equipment in order to be considered a valid tender. It is the sole responsibility of Proponents to ensure that they receive all addenda prior to the Closing Date.

Responses may be withdrawn before the deadline upon written notice delivered, at least 24 hours before the closing time, to the Superintendent of Landfill Operations at the address above or by fax to 250-722-9437.

Responses may be replaced by alternative responses providing written notice (facsimiles of notice will be accepted) is delivered to the Superintendent of Landfill Operations at least twenty four (24) hours before the deadline for closing noted herein.

Responses must remain valid for 60 days following the closing time and date. Responses are irrevocable after the closing time and date.

In the event that the approved proponent does not enter into an agreement with the Regional District, the proponent agrees to pay the Regional District of Nanaimo the difference between this tender and any greater sum which the Regional District may expend or incur by reason of such default or failure to enter into an agreement.

The Regional District of Nanaimo reserves the right to reject any and all tenders for any reason, which the Regional District, in its sole unrestricted discretion deems most advantageous to itself. The lowest or any tender may not necessarily be accepted. The proponent acknowledges the Regional District's rights under this clause and absolutely waives any right of action against the Regional District for the Regional District's failure to accept its tender, whether such rights of action arises in contract, negligence, bad faith or any other cause of action.

In addition to any other provision of this RFP, including the pricing schedule, RDN reserves the right in its absolute and unfettered discretion to reject any Proposal if the Proponent's current or past corporate or other interests are, in the reasonable opinion of the RDN, deemed or perceived to be a conflict of interest in connection with this RFP or the activities or the mandate of the RDN.

The acceptance of any tender is subject to funds being legally available to complete this transaction and approval by the employee or officer having authority to approve this tender and/or approval by the Board of the Regional District.

Unless otherwise authorized in writing by the Superintendent of Landfill Operations, a proponent must not contact or communicate with any elected or appointed officer or employee of the Regional District other than the designated employee in relation to the tender prior to the award of such tender by the Regional Board. Any such communication may result in the disqualification of the tender from further consideration.

The Regional District of Nanaimo is subject to the provisions of the Freedom of Information and Protection of Privacy Act. As a result, while Section 20 of the Act does offer some protection for third party business interests, the Regional District cannot guarantee that any information provided to the Regional District can or will be held in confidence.
