NOTICE IS HEREBY GIVEN pursuant to Sections 464(2) and 467 of the Local Government Act, that the requirement for a public hearing has been waived in connection with proposed bylaw "Regional District of Nanaimo Land Use and Subdivision Amendment Bylaw No. 500.415, 2018" ("Bylaw 500.415"), because Official Community Plans apply to the area that is subject to Bylaw 500.415 and the Regional District of Nanaimo Board of Directors considers Bylaw 500.415 to be consistent with "Regional District of Nanaimo Electoral Area 'A' Official Community Plan Bylaw No. 1620, 2011", "Regional District of Nanaimo Arrowsmith Benson-Cranberry Bright Official Community Plan Bylaw No. 1148, 1999", "Regional District of Nanaimo East Wellington - Pleasant Valley Official Community Plan Bylaw No. 1055, 1997", "Regional District of Nanaimo Nanoose Bay Official Community Plan Bylaw No. 1400, 2005", "Regional District of Nanaimo Electoral Area 'G' Official Community Plan Bylaw No. 1540, 2008" and "Regional District of Nanaimo Electoral Area 'H' Official Community Plan Bylaw No. 1335, 2017".

Bylaw 500.415 affects properties located in the Agricultural Land Reserve within Electoral Areas 'A', 'C', 'E', 'G' and 'H' and received first and second reading at the January 23, 2018 Board meeting. The Regional District of Nanaimo is providing notice of its intent to consider third reading of Bylaw 500.415 at its regular Board meeting to be held at 7:00 pm on February 27, 2018 in the Board Chambers located at 6300 Hammond Bay Road, Nanaimo, BC.

What is the Purpose of the Zoning Amendment?

The proposed bylaw amendment includes new or revised definitions and amendments to the general regulations section to reflect the upcoming legalization of cannabis. Currently, Bylaw 500 allows "Medical Marihuana Production" on land within the Agricultural Land Reserve and the proposed amendments will continue to permit this use on these lands under the new definition "Cannabis Production" to reflect updated federal terminology. The proposed amendments do not change where cannabis production facilities can be located or the land use regulations, such as setbacks that currently apply.

A copy of the Amendment Bylaw and Board resolution waiving the Public Hearing, and other relevant documents may be inspected at the Regional District of Nanaimo office at 6300 Hammond Bay Road, Nanaimo from the date of this notice until February 27, 2018, Monday to Friday (excluding public holidays) 8:30 am to 4:30 pm, with extended business hours until 5:30 on Wednesdays.
