Notice of Waiver of Public Hearing

Notice is hereby given that the Regional District of Nanaimo has waived the holding of a Public Hearing pursuant to Section 464(2) and 467 of the Local Government Act for the bylaw cited as: "Regional District of Nanaimo Land Use and Subdivision Amendment Bylaw No. 500.417, 2018", (Bylaw 500.417).

The Local Government Act permits a local government to waive the holding of a public hearing for a zoning bylaw amendment where an official community plan is in effect for the area that is subject to the zoning bylaw and the bylaw is consistent with the official community plan.

The RDN Board intends to consider third reading of Bylaw 500.417 at its meeting scheduled to be held on Tuesday, December 4, 2018 at 7 pm at 6300 Hammond Bay Road, Nanaimo, BC.

Bylaw 500.417 affects properties adjacent to or influenced by the sea within Electoral Areas A, C, E, G and H.

Purpose of the Zoning Amendment

If approved, Bylaw 500.417 will amend the Land Use and Subdivision Bylaw by incorporating allowances for sea level rise into the requirements for setbacks from the sea and subdivision design that are consistent with Provincial guidelines.

A copy of the Bylaw 500.417, related staff report and other relevant information, may be viewed at the RDN office at 6300 Hammond Bay Road, Nanaimo, BC from the date of this notice until December 4, 2018. Office hours are Monday to Friday 8:30 am to 4:30 pm, excluding public holidays, with extended business hours until 5:30 pm on Wednesdays. This information is also available online at www.rdn.bc.ca

Inquiries and comments may be submitted in writing, and must be received no later than 4:00 pm on the day of the meeting. All correspondence submitted will form part of the public record and may be published in a meeting agenda.
